UPON RECEIPT OF THE PRODUCT, PLEASE INSPECT AND REPORT ANY MANUFACTURER DEFECTS.
POP Board Co. supplies a non-transferable, limited warranty (the “Limited Warranty”) to the original consumer-buyer (“You, “Your” or “Buyer”) of POP Board Co. products against material manufacturer defects arising under normal use of the purchased products (with respect to paddle boards, “Paddle Board Products,” and accessories, “Accessory Products,” and together with Paddle Board Products, “Products”). This Limited Warranty is subject to the following terms and conditions. PLEASE NOTE THAT SOME ITEMS ARE EXCLUDED FROM THE FOLLOWING LIMITED WARRANTIES. THESE ITEMS ARE DISCUSSED AT THE END OF THIS DOCUMENT.
LIMITED WARRANTY DURATION:
• 2 YEARS from the date of purchase of inflatable paddleboards
• 1 YEAR from the date of purchase of electric pumps
• 1 YEAR from the date of purchase on accessory products included with the SUP package
LIMITED WARRANTY ON PRODUCTS COVERS MATERIAL MANUFACTURER’S DEFECTS ONLY, INCLUDING:
• Seam leaks
• Valve Leaks
LIMITED WARRANTY ON PADDLE BOARD PRODUCTS DOES NOT COVER DAMAGE FROM THE FOLLOWING CATEGORIES:
• Misuse of the Products.
• Products that were lost or stolen.
• Damage caused by impact to rocks, docks, shore-pound etc.
• Damage caused by normal wear and tear.
• Damage or defects caused by inappropriate storage in temperatures over 90°F and under 32°F.
• Indents/texture on the PVC that is a result of the drop stitching construction.
• Damage caused by transporting an inflatable Paddle Board Product on the top of a car.
• Damage to fin or fin box caused by impact to the fin.
• Damage caused by overexposure/storage in direct sunlight.
• Damage caused by mishandling, whether or not that mishandling is caused by the Buyer, including without limitation: airline travel, improper loading/unloading into trucks, rolling or dragging on concrete, shipping, etc.
• Acts of God, fire, or casualty.
• Failure to exercise normal maintenance.
• Consequences of uses for which the Product was not designed.
• Damage to the valve caused by loosening the valve to deflate.
• Uses of a Product in ways, including any aftermarket modifications made to the item, other than as expressly provided by the instruction manual or any other documentation accompanying the Product.
LIMITED WARRANTY ON ACCESSORY PRODUCTS DOES NOT COVER DAMAGE FROM THE FOLLOWING CATEGORIES:
• Misuse of the Accessory Products.
• Accessory Products that were lost or stolen.
• Accessory Products used for commercial purposes.
• Damage due to falling on the paddle.
• Paddle filling with water.
• Accessory Products sinking.
• Damage caused by use of Accessory Products outside of their intended purpose.
• Damage due to normal wear and tear, chips, cracks, etc.
• Damage caused by impact to rocks, docks, shore-pound, etc.
• Color fading.
• Acts of God, fire, or casualty.
• Failure to exercise normal maintenance.
• Consequences of uses for which the Accessory Product was not designed.
• Damage caused by mishandling, whether or not that mishandling is caused by the Buyer, including without limitation: airline travel, improper loading/unloading into trucks, rolling or dragging on concrete, shipping, etc.
• Uses of an Accessory Product in ways, including any aftermarket modifications made to the Accessory Product, other than as expressly provided by the instruction manual or any other documentation accompanying the item.
LIMITED WARRANTY PROCESS – SOLE AND EXCLUSIVE REMEDY:
IN THE EVENT OF A BREACH OF THE LIMITED WARRANTY, POPBOARDCO.’S ENTIRE OBLIGATION AND LIABILITY TO THE BUYER, AND THE BUYER’S SOLE REMEDY, IS AS FOLLOWS :
POP BOARD CO. reserves the right, in its sole discretion, to repair or replace any Products deemed acceptable by
POP BOARD CO., in its sole discretion, for a warranty claim. The Buyer will pay all shipping costs associated with sending items in for repair or replacement. To make a warranty claim, please email info@popboardco.com with (1) a proof of purchase and delivery; (2) a written summary of the defect; (3) a picture of the defect, and the serial number located on the paddle board; and (4) a name, phone number, and return mailing address. The buyer must contact info@popboardco.com before making any return based on a material manufacturer defect or in connection with a Product Limited Warranty claim.
Any Product that has not been the subject of a Limited Warranty claim using the process set forth above, within the time period stated within this document, will be deemed to conform to the Limited Warranty and deemed accepted by the Buyer.

WARRANTY DISCLAIMER FOR ALL PRODUCTS
OTHER THAN AS EXPRESSLY SET FORTH HEREIN, POP BOARD CO. EXPLICITLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES WITH RESPECT TO ANY PRODUCTS. SUCH DISCLAIMED WARRANTIES INCLUDE BUT ARE NOT LIMITED TO, WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE PRECEDING LIMITATION MAY NOT APPLY TO EVERY BUYER. THERE ARE NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, THAT EXTEND BEYOND THE LIMITED WARRANTY. THE LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.
LIMITED WARRANTY IS NOT AVAILABLE IN CONNECTION WITH THE FOLLOWING, AND POP BOARD CO. MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ANY OF THE FOLLOWING PRODUCTS:• Products sold to someone under a different name than the name on the order;
• Products purchased from a seller other than POP BOARD CO. For the avoidance of doubt, the limited warranty is available only for items purchased through the following channels: POP BOARD CO. and other online & drop-ship retail partners.
• Products purchased in bulk, with a bulk discount.
• Products purchased for commercial use.
• Products purchased in used condition from POP BOARD CO. or other online retailers & dropship partners.
LIMITATION ON LIABILITY
IN NO EVENT SHALL POP BOARD CO. BE LIABLE TO YOU FOR A MONETARY AMOUNT GREATER THAN THE TOTAL AMOUNTS PAID OR DUE FOR THE PRODUCT(S) IN THE ORDER GIVING RISE TO SUCH LIABILITY. THE FOREGOING LIMITATION APPLIES EVEN IF THE PRODUCT FAILS ITS ESSENTIAL PURPOSE.
IN NO EVENT SHALL

(OR ANY REPRESENTATIVE OF POPBOARDCO) BE LIABLE TO YOU FOR ANY SPECIAL, DIRECT OR INDIRECT, EXEMPLARY INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF GOODWILL, LOSS OR EXPENSE RESULTING FROM THE USE OF OR INABILITY TO USE THE PRODUCTS OR THE PERFORMANCE OR NON-PERFORMANCE OF ANY OBLIGATION UNDER THESE TERMS, OR THE FACT THAT SUCH PRODUCTS DO NOT CONFORM TO THIS CONTRACT OR THE LIMITED WARRANTY, OR IN CONNECTION WITH THE USE OR AS A RESULT OF UNTIMELY DELIVERY EVEN IF SUCH PARTY HAS BEEN NOTIFIED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH DAMAGES OCCURRING, AND WHETHER SUCH LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, PRODUCTS LIABILITY OR OTHERWISE. THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

PRODUCT WARNINGS
YOU ARE RESPONSIBLE FOR READING ANY PRODUCT WARNINGS AND INSTRUCTIONS THAT ACCOMPANY ANY ITEMS YOU PURCHASE FROM POP BOARD CO. POP BOARD CO. IS NOT RESPONSIBLE FOR ANY DAMAGES RESULTING FROM YOUR FAILURE TO ABIDE BY SUCH PRODUCT WARNINGS OR INSTRUCTIONS. PLEASE USE ALL POP BOARD CO. PRODUCTS SAFELY AND RESPONSIBLY.

Bikonit E-bikes Warranty Policy
We sourced all Bikonit e-bikes from reliable suppliers such as Bafang, RST, LG Chem, Sram, Sturmey Archer, Tektro, Kenda, Maxxis, SR, etc. Every Bikonit e-bike was built under a strict production processing and QC system. If you come across with any questions, our warranty policy is as follows:
1)Frame warranty lifetime.
2)All other components on the bike and extra-bought accessories warranty one year.
3)Warranty is valid only in the Continental United States.
THIS WARRANTY DOES NOT COVER:
- Normal wear and tear
- Improper assembly
- Improper follow-up maintenance
- Installation of components, parts, or accessories not originally intended for or compatible with the bicycle as sold
- Damage or failure due to accident, misuse, abuse, or neglect(such as the battery)

1. How to Apply for Warranty
Cyrusher warranty claims can be fulfilled by submitting a support ticket, which is required in order for parts to be replaced under the warranty. This is done via our support page on the website, and will require your order number. The support ticket allows for direct contact with our certified mechanics via email. Once the ticket is submitted, you will receive a response within 48 hours. As part of the warranty process, you may be required to do tests and send footage to the mechanics, so that they may diagnose the issue and provide the best solution. An example of this would be testing a battery using a voltmeter and submitting a picture of the results via email. Cyrusher will evaluate your case and guide you through any tests that we may require.
A) What Will We Do?
If a component is deemed to be defective or damaged without user error we will issue a replacement part. We will replace any parts deemed to have been damaged during shipping. We may also authorize a reimbursement of up to $200 for local bike shop repairs, if determined by Cyrusher mechanics. Any unauthorized repairs or alterations are not covered under the warranty. Any unauthorized changes to the bike will also void the warranty.
Warranty parts can be expedited at the customer's expense, but Cyrusher makes no guarantee of exact delivery date for expedited delivery items. Refunds will not be offered on expedited shipping costs if shipment is delayed. (Note: These notices are applied to the continental 48 states, Alaska and Hawaii will have an additional shipping fee when shipping is needed).
B) What We Will Not Do?
Cyrusher will not replace any part without first seeing photos or video of the damaged part. We will not offer warranty service to second owners. We will not replace any part damaged by the user. We will not pay for any third-party service or part replacement unless agreed upon prior to the fix. Cyrusher will not cover any damage that may occur during shipping if the owner uses its own shipping service. For more information, please check our Return Policy. We will not offer any warranty service to the owners who did not purchase from Cyrusher.com or authorized dealers.
2. Warranty Conditions
Our mechanics are the ones directly in charge of warranty information. They are more than happy to work with you per the conditions as shown below.
This warranty only applies to the original owner of a Cyrusher. This warranty is limited to a one-time replacement of defective parts at the sole discretion of Cyrusher. This warranty does not cover any damage or defects resulting from failure to follow instructions in the owner’s manual, acts of God, accident, misuse, neglect, abuse, commercial use, alterations, modification, improper assembly, wear and tear, installation of parts or accessories not originally intended or compatible with the bicycle as sold, operator error, water damage, extreme riding, stunt riding, or improper follow-up maintenance. Only in extreme cases will an entire replacement bike be issued. In such a case, the original bike has to be shipped to Cyrusher’s facility for inspection/repairs before a new bike is sent out. If repairs can be made, a new bike will not always be sent.
This warranty does not include accessories, consumables, or normal wear and tear parts. Cyrusher will not be liable and/or responsible for any damage, failure, or loss caused by any unauthorized service or use of unauthorized parts. Shipping damage(s) must be reported to Cyrusher via a support ticket. These can be filled out on our support page.
In no event shall Cyrusher be responsible for any direct, indirect, or consequential damages, whether based on contract, warranty, negligence, or product liability in connection with its products, including without limitation to the following: personal injury, property damage, or economic losses.
Cyrusher may charge a minimum service fee, replacement part cost, for cases where the warranty policy may not apply. All replacements are limited to one-time per item. All Individual shipping for warranty must be prepaid and insured by the customer. Cyrusher will not be liable for lost in-bound packages. Cyrusher can void warranty when applicable. Cyrusher reserves the right to update and modify its warranty at any time. Notice of these changes may or may not be provided.
Every electric bike bought from Cyrusher.com and authorized sales channels is covered under our manufacturer's limited warranty for the original owner against defects in material or workmanship, including individual components as follows:
A) 2-Years Limited Warranty
Cyrusher bicycle components including the motor, controller, and frame are warranted against manufacturer defects in materials and/or workmanship for 2 years from the date of original purchase, with a limit of one part replacement, per part, per bike.
B) 1-Year Limited Warranty
Lithium-ion batteries, hydraulic brakes, front fork, rear shock, bike computer, pedal assistant sensor, battery charger, stem, handlebar, headset, seat post, bottom bracket, crankset, rear rack and shifting systems are warranted against manufacturing defects in materials and/or workmanship for 1 year with a limit of one part replacement, per part, per bike. The battery warranty does not include damage from power surges, use of an improper (not designated) charger, improper maintenance, or other misuse, normal wear, or water damage.
C) No Warranty
Please note that gears and accessories are excluded from this warranty policy but included in our Return Policy.
D) Wear Items
Items that wear down with normal use are not covered under the warranty. These items include and are not limited to: chains, rims, spokes, brake pads, tubes, tires, rotors, grips, and seats. Maintaining and replacing these parts is the responsibility of the bike owner.
3. Claims
All claims to this warranty must be made through Cyrusher. Proof of purchase will be required with any warranty request. Before making a warranty claim, we suggest that you contact our customer service team as there may be a simple fix for your problem. Valid warranty claims will be processed through Cyrusher within one year of initial purchase. Warranty claims may be submitted via a support ticket on our support page.
A) Shipping Damage Claims
IMMEDIATELY inspect your product(s) for damage. Shipping damage claims are extremely time-sensitive. We will not accept shipping damage claims later than 14 days from receiving the product. Take notice of any damage to your product(s) on the Bill of Lading before you and the driver sign-off on the shipment. Take pictures of any damage that is found, and date the images when possible. Keep all packaging and paperwork until the inspection process is complete. Report damage claims within 14 days of delivery to Cyrusher via a support ticket on our support page.
B) Credit Card Chargebacks
If for any reason a credit card chargeback of any amount is issued on an order and the customer is still in possession of the product(s) within said order, the warranty will be paused until the chargeback is resolved.
4. Part Exchanges
In situations where a replacement part needs to be sent under warranty, Cyrusher may require the faulty part to be sent back to our facility, as deemed by Cyrusher. The faulty part must arrive at the Cyrusher facility before the replacement part can be shipped. Cyrusher will provide a prepaid return label to return and exchange the faulty part, per Cyrusher authorization. If a prepaid return label is issued for a customer, it is required that the faulty part is returned in a timely manner (within 10 days), unless previously discussed with Cyrusher.
Upon receipt of the faulty/returned part, it will be inspected for shipping damages. If the part is damaged beyond part testing limitations, Cyrusher reserves the right to require payment. Failure to adhere to the terms listed in this section can result in refusal of service, voided warranties, and/or order cancellations permanently.
5. Liability Disclaimer
There are inherent risks that cannot be predicted or avoided when riding any kind of bicycle. These dangers could result in a serious accident, injury, or even death. It is the responsibility of the rider to be aware, educated, and prepared to ride in a safe manner.
Cyrusher HIGHLY recommends that all customers have their bikes examined and tested by a certified bicycle mechanic before the first ride. A full inspection of each component on the bike will help ensure that the bicycle is safe to ride. Cyrusher makes no guarantees that the brakes, shifters, motor, stem, rims, spokes, derailleur, fork, or any other component on the bike will be properly secured and adjusted upon arrival.
Before every ride, fully inspect the bike to ensure that all parts are adjusted and secured properly.
Cyrusher is not liable for any damages or consequences resulting from improper usage, negligence, or assembly of its bikes. This includes but is not limited to personal injury, property damage, economic losses, serious accidents, or death.
6. Bike Performance Disclaimer
Listed top speeds and ranges for each bike are estimates and not guarantees of expected performance. There are many factors that affect bike performance, including but not limited to: PAS level, rider weight, cargo weight, terrain type, incline grade, pedal usage, wind conditions, temperature, and tire pressure. Under different conditions, it is possible to get ranges and top speeds that vary from our listed estimates.
7. Customer Relations
Customer satisfaction is one of our highest priorities at Cyrusher. We work extremely hard to ensure that all of our customers are satisfied with their purchases. Situations and circumstances may arise in which a mutually agreeable solution is not possible.
We understand that when contacting our customer service representatives or mechanics (via support ticket), an issue has arised and a solution is needed. We will work with you to ensure that the issue is resolved in the most timely manner. Inasmuch as we would like to help you, we do require your assistance, cooperation, and patience in trying to resolve the issue. We strive to provide a respectful and kind customer service experience, and expect the same kindness and respect in return.
Rude, vulgar, or threatening language directed at our staff or customer service representatives will not be tolerated. If this unfortunate situation is to arise, a warning will be issued. If rude, vulgar, or threatening behavior persists, Cyrusher reserves the right to refuse service, void warranties, issue refunds and/or cancel orders permanently. We sincerely hope to avoid these kinds of relations if possible.

Micargi USA, Inc. offers a warranty on all parts for 6 months (battery and all electronic parts) and 1 year on the frames starting from the date received for all manufacturer defects. Defective items may be replaced for no cost with proof of the damages and purchase and after our inspection and evaluation.
Exclusions / Non-Returnable Items
Please note our warranty policy does NOT cover:
- Normal wear and tear;
- Paint damage and rust;
- Damage due to improper assembly or follow-up maintenance or lack of skill, competence or experience of the end user;
- Improper maintenance, including follow-up maintenance;
- Damage or failed use due to accidents, misuse, neglect, theft, or abuse;

Tracer USA, Inc. offers a warranty on all parts for 6 months (battery and all electronic parts) and 1 year on the frames starting from the date received for all manufacturer defects. This warranty only covers bicycles and bicycle components purchased through Tracer Bikes or an authorized dealer. The warranty policy exists for abovementioned defects that were already present at the time of delivery of the bike. Subject to our inspection and evaluation, defective items may be replaced for no cost with proof of the damages and purchase.
Exclusions / Non-Returnable Items
Please note our warranty policy does NOT cover:
- Normal wear and tear;
- Paint damage and rust;
- Lost items/parts or damaged keys;
- Damage due to improper assembly or follow-up maintenance or lack of skill, competence or experience of the end user;
- Improper maintenance, including follow-up maintenance;
- Damage or failed use due to accidents, misuse, neglect, theft, or abuse;
- Any modification/installation of components, parts, or accessories not originally intended or compatible with the bicycle as sold;
- Any components that have been modified or tampered with, including but not limited to tires, brake pads, chains, lights, motors, battery packs, displays, controllers, etc.;
- The battery warranty does not include damage from power surges, use of an improper charger, water damage, improper maintenance, or such other misuse or normal wear;
- ALL warranties are void if the bike is used for any purpose other than the reasonable intended use of the bike.

At Velowave Bikes, we take great pride in the quality and durability of our products. We're confident that you will be impressed as well, and we stand behind all of our products. Every ebike we sell is covered by a limited warranty against manufacturing defects subject to the terms below.
Covered Products

This warranty applies only to products, parts, and components (hereafter PRODUCTS) that have been manufactured, assembled, or sold in new condition by Velowave Bikes.

This warranty applies only to replacement repair of PRODUCTS in case of a manufacturing flaw in materials or workmanship, in accordance with the Scope of Warranty Service, and subject to any and all exclusions, limitations, and procedures explained below.

This warranty is not transferable in any way and may not be exercised by anyone other than the original retail buyer (hereafter BUYER) of the PRODUCTS, only if the BUYER has retained constant ownership of the PRODUCTS since their original purchase of the PRODUCTS and only to PRODUCTS purchased in new condition either.
Warranty Period: 2 Years

Battery packs are covered for a 2-year Warranty from the date of original retail purchase or up to 300 charging cycles, whichever occurs first. The batteries are designed to retain up to 75% of their original capacity during that time.

Other electronic components including the motor, controller, display, charger, and throttle are covered under a 2-year warranty from the date of purchase.

Bicycle frames are covered by a 2-year warranty against manufacturing defects.

Mechanical components are covered by a 1-year warranty against manufacturing defects.

For all PRODUCTS, this warranty period is counted from the date the products were delivered to the BUYER unless excluded from warranty or otherwise voided from coverage under warranty.

New Bike Guarantee - we offer full replacement of defective parts with free shipping within the first 30 days of your bike order. After 30 days the customer is responsible for all return shipment costs to Velowave.
Apart from manufacturing defects that could be present, parts that wear due to normal use
such as :
- Bearings
- Brake Pads
- Chains
- Free Hub Bodies
- Handlebar Grips
- Rubber moving parts
- Shifter, brake cables and casings
- Spokes
- Sprockets
- Stripped threads/bolts
- Tools
- Transmission gears
are not included in the warranty but may be replaced on a case-by-case basis within the first 60 days. We shall not be liable if you install, operate, clean, or maintain your ebike without following the owners' manual instructions. Misuse, abuse, alteration, and natural disasters are not included in this warranty.
Note: No official warranty is provided for used e-bikes.
Sea Eagle Warranty Information

Our Sea Eagle boats are covered for a full three years against manufacturer's defects* ... from bow to stern.
We can afford to offer this comprehensive warranty because of our 56 year experience in designing and selling inflatable boats. We know quality products, and we stand behind them.
- Warranty Term will be three years from the date of customer receipt for all non-commercial users
- Commercial operators, including but not limited to rental operators, will be covered for six months from the date of receipt
- Warranty applies to defects in material and workmanship. It does not cover:
- Damage due to negligence, neglect, lack of maintenance, accident, abnormal or improper use, bad assembly or improper repair attempts, or damage resulting from the use of a pump not supplied by Sea Eagle
- Alteration or customization
- Abrasions, tears or punctures
- Normal color fading
- Normal wear
- Overglueing and other aesthetic imperfections
- Crazing, blistering and aging of fabrics, metals or wood
- Does not cover incidental costs such as haul-out, launching, towing, or any other consequential damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
- Customer must provide reasonable documentation to establish a defect, including but not limited to:
- Digital photographs clearly showing the defect
- Troubleshooting to establish or narrow down the cause of the problem
- In the event that a defect cannot be demonstrated by photographs, customer may return products after obtaining an RMA number from Sea Eagle using the procedures for the Return Policy. Returns will be:
- Sent at the customer's expense
- Customer must insure return shipments or accept the cost of merchandise damaged in transit to Sea Eagle
- If Sea Eagle determines the product is defective, customer will be refunded the published common carrier freight charge for the shipment
- Sea Eagle will not reimburse packaging and handling charges incurred by full service operations such as Fedex Kinkos, UPS Stores, or any other packaging and shipping provider.
- For orders exported outside the United States, Sea Eagle Boats, Inc. will not be responsible for any import duties, taxes, or fees associated with shipping replacement products.
- Sea Eagle is not responsible for shipping warranty products to any country other than the country which the original order was delivered to.
- Our obligation under this warranty shall be limited to repairing a defective part, or at our discretion, replacing such part or parts as shall be necessary to remedy any malfunction resulting from defects in material or workmanship as covered by this warranty. We reserve the right to improve the design of any product without assuming any obligation to modify any product previously manufactured.
- Severability: If any provision of this Limited Warranty is unenforceable, for any reason, all other provisions hereof shall remain in full force and effect.

- SEA EAGLE BOATS, INC.’S SOLE OBLIGATION, AND BUYER'S SOLE AND EXCLUSIVE REMEDY, UNDER THIS WARRANTY SHALL BE THE REPAIR OR REPLACEMENT, AT SEA EAGLE BOATS, INC.’S OPTION AND SUBJECT TO THE TERMS AND CONDITIONS OF THIS WARRANTY, OF ANY PART OR PARTS WHICH ARE DETERMINED BY SEA EAGLE BOATS, INC. TO BE DEFECTIVE. WITHOUT LIMITING THE FOREGOING, UNDER NO CIRCUMSTANCES SHALL SEA EAGLE BOATS, INC., BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL, CONTINGENT, OR PUNITIVE DAMAGES, FOR ANY BREACH OF WARRANTY.
- Limitation and Disclaimer of Warranty. - EXCEPT AS HEREIN ABOVE SET FORTH, SEA EAGLE BOATS, INC. MAKES NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, AND THE LIMITED WARRANTY HEREINABOVE SET FORTH IS EXPRESSLY IN LIEU OF ANY WARRANTIES AND REPRESENTATIONS, EXPRESS OR IMPLIED, AND ALL OTHER OBLIGATIONS OR LIABILITIES ON THE PART OF SEA EAGLE BOATS, INC. IF, WITHOUT LIMITING AND NOTWITHSTANDING THE FOREGOING, ANY WARRANTY SHALL BE FOUND TO EXIST BEYOND THE LIMITED WARRANTY HEREABOVE SET FORTH, ANY SUCH ADDITIONAL WARRANTY SHALL BE LIMITED IN DURATION TO THE TERM OF THE REPAIR OR REPLACEMENT WARRANTY PROVIDED FOR HEREIN WITHOUT APPLICATION OF EXTENDED WARRANTY.
- Limitations of Remedies. WATER ACTIVITIES ARE, BY THEIR NATURE, HAZARDOUS. USERS OF SEA EAGLE BOATS, INC.’S PRODUCTS ASSUME ALL RISK AND LIABILITY WHATSOEVER RESULTING DIRECTLY OR INDIRECTLY FROM THE USE OF SUCH PRODUCTS, WHETHER USED SINGULARLY OR IN COMBINATION WITH OTHER EQUIPMENT, INCLUDING ALL RISK OF BODILY INJURY OR DEATH AND WHETHER ARISING IN CONTRACT OR TORT OR OTHERWISE, AND SPECIFICALLY INCLUDING INCIDENTAL, SPECIAL, AND CONSEQUENTIAL DAMAGES. REMEDIES FOR BREACH OF CONTRACT ARISING BY IMPLICATION OR OPERATION OF LAW, EXCEPT AS OTHERWISE PROVIDED HEREIN, ARE EXCLUDED. YOUR BOAT SHOULD ONLY BE OPERATED WITHIN THE US COAST GUARD APPROVED MAXIMUM CAPACITY RATINGS AS STATED ON THE BOAT.
- Restrictions on Limitations and Disclaimers. SOME STATES MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR THE EXCLUSION OR LIMITATION OF THE DURATION OF IMPLIED WARRANTIES. THEREFORE, SOME OR ALL OF THE LIMITATIONS AND/OR EXCLUSIONS OF WARRANTIES AND REMEDIES SET FORTH ABOVE MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY, FROM STATE TO STATE.
- This warranty is void in the following circumstances:
- Any engine larger than the maximum rated horsepower or weight for the boat is used on the boat.
- Boat is used in any activities that are in violation of U.S. Coast Guard Regulations, Federal, State, or any other governing law in the area where the boat is used.
